ECJ Ruling on Vaccines
The European Court of Justice (ECJ) issued a significant ruling on January 30, 2025, in case C-586/23 P, involving Italian physician Giovanni Frajese and the European Commission. This ruling clarified that doctors have the autonomy to prescribe or not prescribe mRNA COVID-19 vaccines, such as Spikevax (Moderna) and Comirnaty (Pfizer-BioNTech), based on their professional judgment and assessment of each patient's health conditions.8 The ECJ confirmed that marketing authorizations for these vaccines do not compel physicians to prescribe or administer them, and any potential liability for adverse outcomes would result from individual medical decisions rather than the marketing authorizations themselves.18
In a separate development, the ECJ ruled that the European Commission unduly refused access to certain elements in the contracts related to the joint purchases of COVID vaccines. The court annulled the Commission’s decision and found that the Commission did not sufficiently justify why access to key provisions, such as indemnification for vaccine-related damages and provisions on donations and resales of vaccines, would undermine commercial interests.2
